Terms of Service

Last updated: 11 October 2026.

By using or paying for I'm Blue, Lda.'s ("PodBy") hosting service, you agree to these Terms of Service ("Terms"). Any material changes will be posted on this website at least one month before they take effect. If you reject the changes, stop using the service. Refunds are described below.

This document was written in English. The English text is the only version for which PodBy can be held accountable.

The service

PodBy hosts static sites and pods on infrastructure in the EU. Static sites are deployed from an uploaded archive or with the PodBy CLI. Pods run a container built from a Dockerfile, or from a container image you deploy, and can run databases in the same pod. The service includes custom domains, HTTPS, logs, environment variables, and daily backups of pods, kept for 7 days.

Each plan has the limits shown on the pricing page. If you go beyond them, we will contact you about moving to a larger plan.

Access to the service

You need a PodBy account and a paid plan. Prices are shown on the pricing page and at checkout. You are responsible for what you deploy and for the traffic it serves. If we disable your account for a breach of these Terms, you will not create another account without our permission.

Payment

We accept payment through Adyen, by card and the other payment methods Adyen supports. Plans are billed monthly. The service is available once payment is confirmed. These Terms apply for the period you have paid for. Adyen's handling of payment data is described in the Privacy Policy.

Refund policy

If you cancel a plan, we refund the unused part of the month you paid for, calculated per day. To request a refund, email help@podby.com and include the email address on the account and the plan you cancelled. Complaints can be sent to the same address.

Acceptable use

You will use the service only for lawful purposes. You are responsible for the applications, files, and configuration you deploy, including environment variables and anything your applications log.

Unacceptable use includes, but is not limited to:

If we learn of unacceptable use, we may ask you to remove the content, and we may suspend or end your access to the service.

Disclaimers

We may change the service by updating the software or the features. We try to avoid interruptions and defects, and we do not guarantee that the service or this website will always be available or accurate. The service is provided "as is" and "as available." You are responsible for your use of it.

Exclusions. To the full extent permitted by law, we exclude all express or implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and freedom from harmful code.

Limitation of liability. PodBy is not liable for any lost profits or consequential, special, punitive, indirect, or incidental damages arising out of or in connection with these Terms or the service.

Applicable law and venue

These Terms are governed by the laws of Portugal. Any dispute arising from them or from the service shall be resolved in the courts of Porto, Portugal, and you submit to the personal jurisdiction of those courts. Consumers may also use any applicable out-of-court dispute resolution mechanisms.

Termination

You may stop using the service at any time. You may delete your account. We may modify, suspend, or end your access at any time, with or without reason.
